    SB 489/98:  Enacted program for victims of domestic violence and allows for voter records and marriage application confidentiality
    Chapter 1005 – Filed September 30, 1998
    An Act to add and repeal Section 2166.5 of the Elections Code, and to add and repeal Chapter 3.1 (commencing with Section 6205) of Division 7 of /title 1 of the Government Code, relating to public records, and making an appropriation therefore.  This bill will also permit a program participant to vote in a confidential manner, as specified, and permit the participant to make marriage application information confidential.

    Gov. Code 6209 and 6209.5:  (Rules given by Secretary of State to facilitate implementation of confidential marriage certificates to program participants)

    **INTERNAL ADMINISTRATIVE PROCEDURE AND AGREEMENT**:
    (Established January 20, 2000—Letter between Bureau Manager and Confidential Address Program Manager)

    Confidential Smog Check Operations:
    Agreement between the Safe at Home, Confidential Address Program and the Bureau of Automotive Repair to perform Smog Tests by providing a Non-Enhanced Area ZIP to program participants.  This verification and information is to be conducted/provided ONLY by Safe at Home Program designated staff, Manager or Specialists and Bureau designated staff.

    AB 184/03:  Vehicle Code 1808.21.d (Record Suppression)
    Chapter 720 – Filed October 9, 2003
    An act to amend Section 1808.21 of the Vehicle Code, relating to vehicles.  Participants in the Safe at Home Program are entitled to have their registration or driver’s license record suppressed from other persons, except as specified, if those persons request the suppression and submit to the department a program participant certificate or identification card issued by the Secretary of State.


    California Education Code: 49076 (b) (1) - Pupils Records Release
    A School district is not authorized to permit access to pupil records to any person without written parental consent or under judicial order except that:
      (b) School districts may release information from pupil records to the following:
        (1) Appropriate persons in connection with an emergency
          if the knowledge of the information is necessary to protect the health
          or safety of a pupil or other persons.

    NEW LEGISLATION 2007

     

    SB 1491/06 Domestic violence:  Personal information.
    Chapter 54 – June 30, 2006

    An act to add Title 1.807 (commencing with Section 1798.79.8) to Pat 4 of Division 3 of the Civil Code, relating to domestic violence.  This bill will prohibit any person or entity that awards grants to victim service providers, as defined, from requesting or requiring, as a condition of an award, the personally identifying information of victims of domestic violence, dating violence, sexual assault, or stalking, or their children, as specified, of the use of specified computer programs or systems that require the disclosure of that personally identifying information.  The bill would also make available to any victim service provider aggrieved by a violation of those provisions, injunctive relief and court costs and attorney’s fees in certain cases.
